The Law of God and the Law of This WorldЗакон бога и закон мира сего
From Petr Chelčický’s The Net of Faith (Síť víry, about 1440–1443), Part I, in Yu. S. Annenkov’s Russian summary (1893), shortened and changed by Tolstoy, who puts its Church Slavonic verses of Scripture into the Russian Bible’s words. Cut from the first edition by order of the Moscow court in 1911, and left out of the second by the censor.
Faith alone can preserve man in the world from errors and from the wiles of the devil; it alone teaches us to discern good and evil; by it alone do we partake of things spiritual and divine.
In our time people believe many things that ought not to be believed; the true Christian faith is held to be error and heresy, and dead customs are taken for faith. A division has come about among people: one side accuses the other of heresy, and from this arise wars and strife, murders, the burning of people, and many other sins; so that faith is not easy to recognize now, for all of it reeks of heresy and enmity. In such circumstances reasonable people must keep the true faith, which was set forth by the apostles and was given once by God through Jesus Christ, and not be carried away by those new beliefs to which people are now being urged.
Among the first Christians the apostles established equality: no one was under any obligation to another, but all were to love one another and serve one another out of love, making up one body joined together of many members, with Christ as its head. Among them there were no rulers holding pagan offices: judges, town councilors. Though the Christians lived under the power of pagans, to whom they had to pay tribute, they did not themselves hold pagan offices. So it went on for more than three hundred years, until Constantine: he was the first to intrude into the midst of the Christians with pagan dominion and with officials such as befitted pagans. The aim toward which the apostles led the Christians was far loftier and more perfect than the one the pagan powers pursued, for to make up one body and be guided by the one spirit of God for religious and moral ends is far higher than to maintain that earthly justice which the pagan powers uphold by various measures of compulsion.
Lawsuits in the courts, though they do help to recover property taken away, lead into sins from which Christians cannot free themselves except by giving up such courts. Christians must not do injustice to anyone or deceive anyone, and must patiently bear the injustice done to them, not rendering evil for evil.
The mutual relations established by the apostles among the first Christians were founded on the law of Christ, which lays down how one is to deal with opponents of the faith, seducers, and heretics: they are to be admonished and reproved first in private, and if this fails, before witnesses, and finally the church is to be told of them; and if they will not heed even the church, then they are to be dealt with as pagans and publicans, that is, one is not to associate with them. In the same sense the apostle forbids association with adulterers and others. Such a Gospel order of society is more likely to correct the corrupted human race than the pagan one with the help of earthly kings and town judges: under the first a sinner can obtain again the grace of God of which his sins deprived him, while under the second death is appointed for all such sinners.
And so the law of Christ alone was quite sufficient for ordering the communities of the first Christians, and, guided by it alone, they prospered morally; but later, when two laws were mixed in among them, the civil and the papal, morality began to decline. This is acknowledged by those who write chronicles, and we see with our own eyes how these two laws destroy and kill faith and the law of God. Therefore we, late descendants, sitting as it were in the shadow of these laws, speak uncertainly of the law of God and the government of God, for the darkness of these two laws screens our eyes. Therefore, groping, so to speak, and guessing, I put the question: is the law of Christ sufficient, without the human laws added to it, to found and order here, on the earthly way, a wholly Christian religion? I answer, though with trembling: yes, it is sufficient now as well, because it was sufficient before for ordering Christian society. The law of Christ is weakened neither by the resistance offered to it nor by the multitude of those who have turned to it: on the contrary, it has gained still greater strength from this, and so it alone is always sufficient. Further, if it was sufficient for turning unbelievers to the faith, then it is sufficient also for ordering life and morals, for the latter is easier. And since government by the teaching of Christ is better than government with the help of human admixtures, who will doubt that people would be more perfect if guided by the law of God than if they dosed themselves, as with poison, with various admixtures?
Civil law, or the law of pagan kings, has the aim of establishing justice among people in everything that concerns man’s body and bodily property; the law of the Gospel, on the contrary, has as its aim the spiritual perfecting of people. Since pagans place their good only in the safety of body and property, they hold to civil government. In just the same way, those Christians too who have turned to paganism, rejecting God and his law, and who strive only for earthly pleasures, for freedom and ease in the world, and for bodily enrichment, also stand for the secular power, which indulges their desires and, in case of danger threatening their life or property, puts weapons to use or makes it possible to recover lost property through the courts. The justice that the secular power strives to establish is necessary for the rulers themselves: if one went against another and in general did evil to another, the kingdom itself would fall apart. The secular power does not concern itself with the other virtues, and therefore, apart from injustice, it permits every other sin.
The government of Christ orders man spiritually in the virtues and brings him to such innocence that he can please God and earn a reward in eternity. Under this government man regards bodily deprivations quite differently: he does not avenge them and does not seek satisfaction in court, but bears them patiently.
Equality was established among the Christians, and no one was to raise himself above others; therefore a true Christian would never have dared to make himself king over Christians. Moreover, the apostolic commandment is binding on Christians — to bear one another’s burdens: how then can a good Christian bring himself to be himself a burden to others by becoming a king?
That royal power is a heavy burden for subjects is seen from this: after the death of Solomon the Jews asked his son to relieve them of his father’s cruel servitude and of his heavy yoke, and Rehoboam, having taken counsel with fools such as he was himself, answered harshly: “My finger shall be heavier upon you than my father’s back.” From this it is seen that even Solomon, the wisest of all, was by his power a heavy burden to the people.
Jesus Christ himself forbade his disciples to exalt themselves over one another: “Kings hold sway over the nations, and those who rule them are called benefactors. But you are not so: whoever is greater among you, let him be as the lesser, and the one who leads as the one who serves.” And in the Old Testament Gideon refused the offer of the Jews to be king over them and answered: “I will not have dominion over you, nor shall my son have dominion over you: the Lord shall rule over you.”
Love of God cannot be called forth in man by measures of compulsion: it is founded on man’s free will and is born of the word of God. And if a king sets about correcting evil people by preaching the word of God, he will turn into a priest and will not resort to that power which corrects people in no other way than by hanging them.
To people who appropriate pagan power so as to make themselves a life of luxury at the price of others’ sufferings, one may apply the Old Testament parable of the trees, which turned to the olive tree, the fig tree, and the vine with the request that they reign over them. Neither the one, nor the other, nor the third consented, because they would have had to lose everything that made up their charm, and only the thornbush answered: “If you have chosen me king, then come under my shade; and if you do not want to, then let fire come out of me and devour the cedars of Lebanon.”
People who possess the gifts of God’s grace will not exchange them for the goods of the body and of the world, for dominion and advancement, knowing that all this brings with it cruelty, mercilessness, violence, and the plunder of their own brothers; but the thornbush, sharp and cruel, boldly says: “Since you have chosen me your lord, know that I am your lord and will rule over you so that on some not even the skin will be left whole: I will clip their wings, I will strip the peasant like a linden.” And another will say to this: “Never mind! Strip the peasant: he’ll recover, like a willow by the water.” People who live in luxury, with big bellies grown through with fat, justify such treatment of the common people.
No human law can further the moral perfecting of people to such a degree as the law of God. The law of Moses was a good law, but a Christian ruler cannot be guided by this law, since it has already been transferred and replaced by another law — the law of Christ, and the law of Christ is founded wholly on love of God and of one’s neighbor.
The intrusion of two lords, the secular and the spiritual, into the Christian church broke that state of purity and innocence in which it had been established by the apostles and in which it remained for three hundred and twenty years. And though many people consider this intrusion useful to the faith, this poison never was and never will be faith, but will always remain a poison that poisons people and deadens faith; and so Christians must remember that, keeping the true faith, they cannot hold sway over others after the pagan custom. And yet the apostles of antichrist count this secular power as the third part of the church.
According to the teaching of the Roman church, the secular power is founded on Holy Scripture, and above all on the following text: “Soldiers also asked him: And what are we to do? And he said to them: Do no one wrong, do not slander, and be content with your pay” (Luke 3:14).
These words by themselves could not have sharpened a sword for Christians, so that they might shed human blood by them; but the great pillar of the Roman church (Augustine), who props it up mightily so that it should not fall, gave this passage the sense of a sharp sword among Christians. He puts it thus: “If Christian teaching condemned war altogether, the soldiers who turned to John would rather have been given the saving counsel to lay down their arms and leave the soldier’s profession; but since he bids them be content with their wages, he does not reject the soldier’s profession and does not censure war.”
The second passage to which the Roman church appeals is the following: “Let every soul be subject to the higher powers, for there is no power except from God; and the powers that exist are established by God,” and so on (Romans 13:1 ff.). This is the chief foundation on which the learned rest the secular power, and a master of the University of Prague told me that I too must acknowledge this, and that if I did not, I would be a heretic.
Here are some more of the master’s arguments in proof that human law, which punishes people with death for certain acts, does not contradict the law of God: 1) The commandment “Thou shalt not kill” does not forbid punishing the guilty with death, for in such cases it is not the judge who kills, but the law that compels him to it; 2) God multiplies life and death, and so he may also kill: I will kill, and I will make alive; and kings are set up by God, and so they may do the same; 3) the apostle Paul says: “They who do such things are worthy of death, and not in vain does he bear the sword”; 4) in the Gospel: “But those enemies of mine who did not want me to reign over them, bring them here and slay them before me”; 5) Cyprian, on the Old Testament commandment to kill idolaters, says that if such a commandment existed before the coming of Christ, all the more must it be kept after his coming, as is confirmed by the words of the apostle Paul: “They who do such things are worthy of death.”
Augustine and Jerome interpret the commandment “Thou shalt not kill” in the same way.
St. Gregory reasons about it in the same way, and again St. Augustine. From all these arguments it comes out that they want to make God two-mouthed, so that with one mouth he should say: Thou shalt not kill, and with the other — Kill.
Jesus is very poor now; crowds of people no longer follow him, unless some outcast and unreasoning person trails pitifully after him, like a fly out of the slops. The learned, on the other hand, are very rich and renowned in the world; they have begotten many servants of God with the sword, and the whole world looks upon them. The wise man of the world will glance at Jesus, see that he is forsaken by all, clothed in poverty, suffering hardships, and will leave him and go to the learned, who, by their laws, serve God in whole crowds in churches, in war, at tortures, in government offices, at the pillories, and at the gallows. The wise man of the world will seize on such a broad service of God, and only a fool will follow Jesus, and the world will hiss at him.
Most of all, service with the sword is contrary to the teaching of Christ, because the whole of it consists in paying evil for evil. Though they stipulate that the sword is raised for a cause not one’s own, but God’s, God knows how sincere this stipulation is: if it were so, people would not avenge the injuries and injustices done to themselves; but in fact it turns out that they do not leave the slightest injury by word unrequited, while they tolerate outrage against God. Christ, on the contrary, commanded us to love our enemies and to pay them good for evil. When the Samaritans did not receive him, he did not allow the apostles to bring down fire from heaven. Christ cared more for the souls of his enemies than for his own temporal sufferings. If people believed the words of Christ and followed his example, there would be no wars on earth. Battles, and other killings, and every hostile assault on others, and every requital of evil for evil come only from our not loving our enemies and not bearing with patience the injuries done to us.
With the order of a truly Christian society shown in Holy Scripture, the sword and all its works, that is, battles and all bloodshed, have nothing in common, being contrary to the calling of Christians and to the virtues that befit them. Christians are united by the one faith of Christ; they pray for one another: forgive us our debts, as we forgive our debtors; they are bound together by a union of love and peace: after all this, can any one of the monks of old, glorified as saints, prove on the ground of faith that Christians must have battles and killings? Christians who raise wars and commit other bloodshed are Christians in name only and follow the pagans, with only this difference, that the pagans did not know God and had no share in those spiritual goods to which Christians lay claim. Nor can battles among Christians be compared with the battles of the Jews, for the latter were permitted by the law.
Christians who kill one another in battle are in any case deprived of a share in the spiritual goods promised by Christ. If they justify themselves by saying that they have too much to do with the world and so have no time to think of higher spiritual things and grasp them, then they may be answered briefly: in vain do they believe in Christ, in vain are they baptized. And if Christians consider themselves sharers in the sufferings of Christ and hope for salvation, and at the same time crucify Christ in themselves by killing one another, then punishment and curses greater than the pagans’ await them.
Battles among Christians are contrary to the law of Christian love, which forbids every hostile assault on one’s neighbor, on his body, soul, property, honor — by deed or by word, and teaches us to bear without murmuring the injustices that others do us.
The apostle defines the mutual relations among Christians thus: “Remain in debt to no one for anything, except mutual love” (Romans 13:8). In these words the difference between the works of faith and the works of pagan dominion shows itself: the one cannot be the other. That is why the union of paganism with Christianity could not come about at the very beginning. In the beginning some found comfort in drinking the blood of Christ, others in shedding human blood; but now both have united in a common service of God: they drink the blood of Christ and draw the blood of their neighbors.
There are two extremes: either to reject God completely and fall away from him, or to cleave to him with all one’s heart. But neither the one nor the other is easy for people; for man is not so depraved as to reject God entirely; on the other hand, few will be found who would want to cleave to God with all their heart. Faith founded on the papal laws is something between the one and the other, and on this most people rest content. It prescribes various good acts, false and seeming, which find expression in various outward rites, and people think that they keep the true faith, confessing God with their lips alone and expressing their reverence by outward signs alone.

One sentence of Annenkov's § III, word for word without its opening «Итак» (So). Annenkov's sentence sums up a page of Chelčický's ch. 3: the net of faith alone keeps a man alive in the darkness of this world ("Petrova siet viery jediná k zachování života ostává člověku"); without faith we can call nothing good or evil ("Nemuožem bez nie ničemuž řieci zlé ani dobré"); of divine things we can know nothing except by believing. The opening of Annenkov's § V, word for word (Tolstoy's «через» for «чрез»). He stops before the rest of the section: the pope's letters of indulgence and the burning of those who doubt them, the false miracles of the passionals, and Jude 3. Here the Russian follows Chelčický's ch. 5 closely: the worst of times, when true faith is held for heresy and dead customs for faith; two sides that call each other heretics; wars, murders, and burnings; faith that "smrdí všicka kacieřstvím a nepřiezní" (stinks all of heresy and enmity). The faith given once through Christ by the apostles is Chelčický's reading of Jude 3, a few lines on.

Source text: antimilitary.narod.ruDále muožem znáti, že jsú apoštolé ten lid v rovnosti ustavili …… ani těch zprávcí s úřady pohanskými, rychtářuov, konšeluov k sauduom svárlivým …Nebo ti zborové Kristovi trvali jsú mezi pohany bez moci světské viece než tří sta let až do Konstantina; …Ale býti jedno tělo a všickni týmž duchem božím se zpravovati u věcech božských a duchovních …Source text: archive.orgDetails

Annenkov's § VII entire, with two words changed. Annenkov has «в делах религиозных и нравственных» (in matters religious and moral), after Chelčický's "u věcech božských a duchovních i mravných"; Tolstoy has «в целях религиозных и нравственных» (for religious and moral ends). Annenkov has «ту земную слабую справедливость» (that weak earthly justice), after Chelčický's "pravdu zemskú nemocnu"; Tolstoy drops «слабую» (weak). Annenkov's «Напротив, суды в ратхаузе» (On the contrary, the courts in the town hall), after Chelčický's "rathauzní saudové" (town-hall courts), is Tolstoy's «Суды в судилищах» (The courts in the courts of law); the rest is word for word (Tolstoy's «несправедливость» for «несправедливости»). Tolstoy leaves out § VIII, on the courts Paul allowed the Corinthians "to your shame" (1 Corinthians 6:5), and the end of § IX, where the clergy make that shame a law. Source text: antimilitary.narod.ru… kdež se zlá věc urodí mezi věrnými křesťany, z domácích svých když se zjevie odpuorce, pohoršitelé, kacieri.… ale bud tobě jakožto pohan a zjevný hřiešnik, varuj se jeho …… kterak ta zprava čtenie padlému pokolení lidskému jest užitečná k opraveni jich padlosti nad zprávu pohanskú skrze krále zemské a rychtáře městské.A to jest prostě dobrá zpráva, podle niež hřiešný muož milosti božie dobyti zase.Source text: archive.orgDetails

The Russian follows ch. 37 closely: Chelčický's "Deř sedláky" is «дери с мужика» (flay the peasant), and his man "širokého břicha a tukem prorostlého" (of broad belly, grown through with fat) is Annenkov's «с толстым брюхом, проросшим салом». Source text: antimilitary.narod.ru… neb jinak nižádný nemuož polepšen býti na svědomie skrze jmý kterýžkoli zákon lidský než toliko skrze zákon boží.To jest zákon dobrý, nebo jest jej Buoh vydal lidu svému zvláštnímu.… nemuož, nebo jest zákon přenesen a konec zákona židovského jest Kristus …A že^*) ten zákon všechen záležie na milování Boha a bližního svého.Source text: archive.orgDetails

From the beginning of Annenkov's § XXXVI, which Tolstoy places after § XXXVII (W.13). He drops the clause «ибо сам Бог дал его своему избранному народу» (for God himself gave it to his chosen people), after Chelčický's "nebo jest jej Buoh vydal lidu svému zvláštnímu". His «перенесен» (carried over) is Chelčický's "přenesen"; the transcription's «принесен» is a misreading. The Russian condenses ch. 36, leaving out Chelčický's argument that one work of the old law, circumcision, cost the Galatians Christ (Galatians 5:2-4), and that wars and murders done under that law cost more.

Source text: archive.orgDetails

Annenkov's § XXXVIII (numbered «XXXIII» in the transcription), its opening «Из всего вышеизложенного видно, до какой степени» (From all the foregoing it is seen to what degree) dropped and the sentence made a plain statement. Tolstoy cuts the end of the second sentence: Christians «не могут покупать людей, искупленных Христом, для которого и пан и пастух равны, ибо Он столько же крови пролил за пастуха, сколько и за пана» (cannot buy people redeemed by Christ, for whom lord and shepherd are equal, since he shed as much blood for the shepherd as for the lord). The transcription's «третьего» is «третьею». The Russian follows ch. 38 closely, leaving out its last image: Antichrist's apostles have counted these oppressors the third part of the Church "jako vlku pastýře ovcí" (like a wolf the shepherd of the sheep).

Where Annenkov has «Вот некоторые из доводов мистра» (Here are some of the master's arguments), Tolstoy writes «Вот еще некоторые из доводов магистра» (Here are some more of the master's arguments), so that they read as the arguments of the Prague master of W.18. Luke 19:27 is given in the Synodal Russian («Врагов же моих, тех, которые не хотели, чтобы я царствовал над ними, приведите сюда и избейте предо мною») where Annenkov has the Church Slavonic; Deuteronomy 32:39, Romans 1:32, and Romans 13:4 stay in the Slavonic. In Romans 13:4 Annenkov's «не бо без ума меч носить» (for he beareth not the sword in vain) is printed «небо без ума меч носит», «небо» (heaven) for «не бо» (for not), as the Jubilee edition gives the Circle. Annenkov's § LXXX entire, with one list changed. The Russian condenses ch. 81 to its arguments, in order: the pretext that the sword serves God's cause, not one's own; the command to love enemies; the Samaritans (Luke 9:54-56); and the conclusion, close to Chelčický's ("Protož bojové a jiní mordové... jinde se nepočíná, jediné z nemilování nepřátel a z netrpenie bezpráví").
